RELEASE and WAIVER of
LIABILITY,
ASSUMPTION
of RISK, and
INDEMNITY
AGREEMENT
I freely agree to and make the following
contractual representations and agreements:
- I fully realize
the dangers of participating in bicycle rides, races, tours, and training and fully assume the risks associated with such
participation including, by way of example, and not limitation, the following: the danger of collision with pedestrians, vehicles,
other riders, and fixed or moving objects; the dangers arising from surface hazards, equipment failure, inadequate safety
equipment, and weather conditions; and the possibility of serious physical and/or mental injury.
- I hereby waive, release, discharge and covenant not to sue for myself,
my heirs, executors, administrators, legal representatives, assigns, and all rights and claims which I have of which may hereafter
accrue to me against Joy Riders, through or by which the events will be held for any and all damages which may be sustained
by me directly or indirectly in connection with, or arising out of, my participation in or association with the event, or
travel to or return from the event.
- I agree it is my sole responsibility to be familiar with any rules of
the Joy Riders, applicable laws, and any special event regulations. I understand
and agree that situations may arise during Joy Riders activities which may be beyond the immediate control of the Joy Riders
members or event organizers. I will ride wearing a helmet which satisfies the
current safety certifications during all club rides and assume all responsibility and liability for the selection of such
a helmet.
- I agree
to allow any and all information listed in the membership form on the left to be made available to all
club members via an email attachment.
I agree for myself and successors, that the above representations are contractually binding, and are not mere recitals,
fully understand its terms, understand that I have given up substantial rights by agreeing to it freely and without inducement
or assurance of any nature and intend it to be a complete and unconditional release of liability to the greatest extent allowed
by law.
If I have listed any children under my membership with Joy Riders,
I verify that I am the legal guardian of said children and that I agree on their behalf to these terms and conditions.
If I choose to ride with Joy Riders on a club ride but have not joined as a member, I am still bound by
this agreement as a "Guest Rider."
The website (http://www.cyclestar.org/joyriders) serves as the only official communication of
the club and I am responsible to remain aware of the contents of the site and conditions under which I may participate
as a club member or guest rider.
My
submission of the membership form serves as a perpetual agreement to these terms and conditions.
